Terms of Service

Please read these Terms of Service carefully before using DocketSync. By creating an account or using the service, you agree to be bound by these terms.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Thomas C. Thomasian, Esq., operating DocketSync ("DocketSync," "we," "us," or "our"), governing your use of the DocketSync web application and related services (the "Service") accessible at mydocketsync.com.

You must be a licensed attorney or authorized legal professional to use DocketSync. By using the Service, you represent and warrant that you are licensed to practice law and that your use of the Service complies with all applicable professional rules and regulations, including the Rhode Island Rules of Professional Conduct.

4. Account Registration

You must create an account to use DocketSync. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at tct@thomasianlaw.com.

5. Subscription and Payment

Plans and Fees

DocketSync is offered on a subscription basis. Current pricing plans are displayed at mydocketsync.com. All fees are in U.S. dollars.

Free Trial

We may offer a free trial period. At the end of the trial, you must subscribe to continue using the Service. We reserve the right to modify or discontinue free trial offers at any time.

Billing

Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. Payment is processed through our third-party payment processor. By providing payment information, you authorize us to charge your payment method for all fees due.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods except as required by applicable law.

You agree to use DocketSync only for lawful purposes and in accordance with these Terms. You agree not to:

7. Gmail Integration

The Ready Subject feature requires connecting your Google Gmail account via OAuth. By connecting your Gmail account, you authorize DocketSync to create draft emails on your behalf. DocketSync will not read, modify, or delete existing emails or access any Gmail data beyond what is necessary to create drafts as directed by you. You may revoke this authorization at any time through your Google Account settings at myaccount.google.com/permissions.

8. Intellectual Property

The Service, including its design, code, features, and content, is owned by Thomas C. Thomasian, Esq. and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your lawful professional purposes during your subscription term. You may not copy, modify, distribute, or create derivative works based on the Service.

You retain all ownership of the data you upload to DocketSync, including court schedules and client information.

9. Confidentiality and Professional Responsibility

DocketSync processes court appearance data that may include client names and case information. While we implement reasonable security measures as described in our Privacy Policy, you are solely responsible for ensuring your use of DocketSync complies with your professional obligations regarding client confidentiality under Rule 1.6 of the Rhode Island Rules of Professional Conduct and any other applicable rules governing the use of technology in legal practice.

DocketSync is a productivity tool. It does not provide legal advice. No attorney-client relationship is created between you and DocketSync or Thomas C. Thomasian, Esq. by virtue of your use of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that parsed court schedule data will be accurate or complete. You are responsible for verifying all court dates, times, and information through official sources.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOCKETSYNC OR THOMAS C. THOMASIAN, ESQ. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR MISSED COURT APPEARANCES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless DocketSync and Thomas C. Thomasian, Esq. from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any applicable law or professional rule.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, 11, 12, and 15 survive termination.

14. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service at any time. We may also update these Terms from time to time. We will provide notice of material changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Providence County, Rhode Island. You consent to personal jurisdiction in those courts.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DocketSync regarding the Service and supersede all prior agreements and understandings.
